Can I secure custody of my grandchild?

As a grandparent, you want what is best for your grandchild. It can be impossible to sit back and do nothing if the child’s parents are not providing the home they should. You may even want to take over the task of raising your grandchild. Is it possible to assume custody if the parents are not ready to give up their custody rights?

Protecting parents’ relationship with their children

Arkansas primarily believes that it is in a child’s best interest to be kept with both of their parents. However, this can be overruled if this situation is physically or emotionally harmful for the child. This could be due to many factors, including:

  • Parent drug or alcohol abuse
  • Domestic abuse
  • Sexual abuse
  • Neglect or abandonment of the child
  • Parents are in jail
  • Parents are physically or mentally ill

If your grandchild faces one of these realities, you have a much better chance of establishing custody rights. However, it is still very difficult for grandparents to gain custody rights in Arkansas. Another option may be to become your grandchild’s legal guardian.

Understanding the role of a guardian

As a guardian, you would oversee your grandchild’s physical and financial well-being. You assume responsibility for their day-to-day care, education, home life, medical care, financial assets and ensure all needs are met. You would in essence assume the role of the child’s parents.

It can be difficult to navigate Arkansas’s legal system to establish guardianship or custody. If you have questions, consider speaking with an experienced family law attorney to explain your rights and how you can best support your grandchild’s well-being.
