What are the duties of a guardian?

If you have been named a guardian in an estate over a minor child or adult, then it is imperative that you understand what your responsibilities are. Being a guardian is a very serious matter than requires you to do specific things. According to the Arkansas State Legislature, you can even be held personally liable if you make the wrong decisions as a guardian.

One of your duties is to file a report annually with the court. This report should provide any requested information, along with information about your ward that includes living arrangement and health status. You must also report of the status of the estate.

Your main duty above all else is to provide care and protection for your ward. You also must ensure the person gets proper education, has the ability to seek employment, if applicable, and that he or she maintains a good lifestyle according to the estate.

There are also some things that you cannot do. Sometimes you may be allowed to do some of these things, but you would need court approval. You cannot withhold any life-saving medical treatment or authorize experimental treatments. Along with this, you cannot consent to brain surgery for the treatment of a mental disorder, approve an abortion or sterilization or consent to organ removal except in the case that removing an organ is needed to save the person's life. You cannot consent for any legal settlements, stop the person from getting a driver's license or terminate the person's parental rights. This information is for education and is not legal advice.
