1 dead, 1 injured in head-on collision

One person was killed and another was injured from an accident that occurred in Arkansas on June 20. The incident happened at approximately 4:30 a.m. on Highway 59 near Gentry. According to police, an 18-year-old female was driving northbound in a 1997 Nissan Maxima on Highway 59 as a Simmons semi-truck was headed south in the opposite direction. Her vehicle crossed-over the centerline and into the direct path of the semi.

The truck driver attempted to perform evasive maneuvers but was unable to avoid a collision with the passenger vehicle. The truck sustained damage on the left front-side after colliding head-on with the Nissan. Investigators believe the female driver in the Nissan may have fallen asleep behind the wheel. The 58-year-old trucker was brought to Fayetteville's Washington Medical Center to receive treatment for his injuries.

In a crash where the accused driver dies, an injured motorist may be able to file a personal injury claim against the at-fault driver's estate. He or she may be entitled to recover restitution that can help account for medical costs, repair expenses, loss of income and any other damages related to the accident.

A fatigued driver who causes a crash may be considered negligent or reckless in some cases. Aside from examining police reports, a lawyer may also use an accident reconstruction summary to gain insight into how an accident occurred. Additionally, a lawyer may also be able to negotiate an adequate settlement amount with insurers that address a victim's financial losses due to the crash.
